explosion in san bruno. we've also learned that the company's expected to turn over a list of the most at-risk sections of the pipeline system, but only after being ordered to do so by state regulators. monty francis is in san bruno tonight with the information for us. monte? >> reporter: this lawsuit is seeking class action status. it's also seeking to change how that $100 million victim's fund is managed. a homeowner by the name of steve dare is suing pg&e. his house was not damaged in the fire, but he was evacuated from his home for three days. he names himself and others similarly situated as plaintiffs. they accuse pg&e for the explosion that killed seven people and detroit 40 homes here on september 9th. the suit seeks to turn over the $100 million victim's fund set up by pg&e to a third party that would manage that money. it also seeks damages beyond that amount.

pg&e is expected to turn over the list of the 100 most at-risk sites to the public utilities commission on monday. >> i think the people and the residents have a right to know where these pipes are, so that they can make a conscious decision, should i live here? >> state senator leyland yee's office tells us the information is scheduled to be handed over to the puc at 2:00 monday afternoon. the senator expects the information to be made public then. pg&e has refused to turn over that information, arguing it would be a threat to national security. monty francis, nbc bay area news. >> thank you, monty. a funeral is scheduled to begin in about an hour for a victim of the san bruno explosion. jessica morales. last night family and friends gathered for a vigil in her honor as well. there's more scheduled for the san bruno community this coming week. tomorrow nine bands will play an outdoor benefit concert.

all funds raised will go to the victims. and crews could start clearing the ruins of the 37 homes that were destroyed as soon as thursday. county health leaders are concerned about potentially dangerous metals and asbestos in the debris. further south a fund-raiser tonight for a city council candidate in san jose is drawing quite a crowd, because the conservative candidate supported proposition eight the anti-gay marriage initiative. supporters say they're shocked that their democratic mayor is endorsing the conservative candidate. kimberly perry is in san jose with a look for us. kimberly? >> diane, this fund-raiser is going on right now as you can see here at the home of city councilman peter constant. a fellow republican who has endorsed larry pegram. we're waiting the mayor to arrive right now. peter compton's home is in a cul-de-sac. they're at an entrance to his

court holding signs and being very outspoken. they're concerned that the mayor, a democrat is also endorsing pegram. they say pegram's been very outspoken about his support of prop eight and is keeping their family as part. councilman peter compton said he endorsd pegram because he needs his help at city hall to deal with the budget. he wants someone who is focused on fixing the city's fiscal problem. >> i think it's important to put into perspective what local government does versus what state and federal government does. i don't agree with larry on all his social issues. everyone has their own particular viewpoint on each of these issues, when it comes down to it, those are issues that don't come before the city council. >> we support the firefighters, we do not support mr. pegram's clear support of the program. his advocacy for a strangely

conservative and bigoted organization makes him a very poor candidate. >> san jose city firefighters are also out here standing in unity with the lgtb leaders in silicon valley. firefighters have recently butted heads with the mayor on contract issues say tharg not doing what's right for the city endorsing pegram. larry compton expected the protesters, including the firefighters tonight. he stands behind his decision to back pegram saying he looked at both the candidates for district nine and pegram is more fiscally conservative. according to him that is exactly what san jose needs. kimberly terry, nbc bay area news. the uc graduate released from iran after a year in custody is on her way home to the united states. sarah shourd thanked oman for mediating her bail. she did not give any details

just 16 years old. police say he lost control of his car going through a curve too fast, and ended up right in front of the tractor-trailer hauling cattle. a 15-year-old in the back of the car was killed. three 17-year-olds and the driver were all hospitalized for injuries ranging from moderate to critical. the driver of the trailer was not seriously hurt and witnesses say that driver ran to help the teenagers immediately after the crash. budget talks are set to start up again on monday after legislative leaders left yesterday with no agreement on how to close the $19 billion state budget gap. some critics are suggesting this latest delay is deliberate, and part of political maneuvering tied to the november ballot. kevin riggs with our nbc station in sacramento has the latest on what is now the longest california budget stalemate ever. >> no sense of urgency at the capital where lawmakers and the governor have taken the weekend off from talks, even though the budget is now a record breaking 80 days late.

>> i find it unacceptable. >> capital visitors say the irresponsibility is appalling. >> i think if i didn't pay my bills for 80 days i would have creditors coming to my house and taking things. >> as long as they continue to screw around and take a long time and not view their job in a timely manner, they're going to be out of office real soon. >> without a budget, health care providers and other vendors are going unpaid. state workers are being furloughed, now an anti-tax group says all this pain is deliberate. >> i think this is a strategy that calls for delaying the budget until -- as much as possible to make an issue of the budget delay. >> an issue says the taxpayer's to build support for proposition 25. that measure would reduce the budget vote requirement from two thirds to a simple majority. >> only two other state notice nation besides california require a 2/3 vote for passing the budget. arkansas and rhode island. democratic leaders here in the legislature made it clear

san mateo county health leaders hosted a free whooping cough vaccination today. the lines stretched around the block. the number of cases in the county is nearly eight times what it was last year. the entire state is on track to break a 55-year-old record for the disease. health leaders are encouraging everyone older than seven to get a vaccination. especially those in close contact with newborns. whooping cough is especially dangerous for infants. nine babies have died in california after coming down with the illness this year.  more than 1 million people in california will soon see their health insurance premiums go up come the first of october.

the state department of insurance cleared aetna yesterday to raise rates an average of 19% for 65,000 individual policyholders. it was the last of four major insurers to be reviewed by the department of california. the insurance department has approved double-digit increases for anthem blue cross, blue shield of california and health net as well. those four companies control 90% of the state's individual policies or about a million people. aetna says the increases are necessary to keep up with rising health care costs. despite the fact that aetna recently announced its second quarter profits rose 42%, and aetna also increased its full year forecast for profits as well. the south bay is now host to the largest buddha in the world, and size isn't the only thing that makes it a little unique. it's also carved entirely out of jade and gemstones. the official name of the piece is the jade buddha, for

but what really happened? cnn -- not me -- cnn says his assertion about his tax record was "just plain wrong." jerry brown went out there and took credit for the fact that the people of california voted for proposition 13, which lowered taxes, which he opposed. and now he's going around taking credit for it. he raised taxes as governor of california. he had a surplus when he took office and a deficit when he left. he doesn't tell the people the truth.

this is not something you probably see while riding public transit every day. i would think not. that's the entire point of the dance, and the transit movement. anyone who rode the light rail today could stop at four locations where the dancers were performing for fun. >> there's so much awareness of arts in san francisco, and there's a lot of art that happens in, especially dance art that happens in the south bay. we're trying to raise awareness, and make it more accessible to the public. >> if you missed it, you can check out the dancing tomorrow from 11:00 to 4:00 at a couple of the light rail stops.

after a pair of opening week losses, the bay area's professional football teams are ready for a do over. first up, the raiders. they have another game tomorrow at the coliseum with the help of the rams and the heisman trophy winner. he was the talk of the draft and ended up going number one over all in april. sam bradford the starter in the nfl.

he threw his first touchdown last week. he's likely to make some early mistakes, and the raiders are more than happy to help him do just that. >> any time you get a rookie, they're not going to be as experienced as some of the vets who play in the game pup want to keep pressuring him. and make him make hard decisions. and cover receivers tight and things like that. you want to make them, try to force them to make mistakes. >> an offense averaging nearly 44 points per game so far this season. but tonight they're beat in one of those counts. wake forrest has put up more than 100 points in its first two games of the season. >> it's a great challenge, because they do so much. there's so much variety to their game both offensively and defensively, they're expert at it. that staff has been together

three-run shot. the padres go up 7-4. they get the win 8-4. and the dodgers are not even pretending to care any more. first they traded of course tav yo to the rockies before today's game, then they rolled over during it. troy tulowitzki taking over. the rockies shortstop continued his hot september. two home runs today. that gives him 14 homers in his last 15 games. the rockies win 12-2, now, one game behind the giants. the padres a half game behind. making tonight's game even more important. the only thing that stood between kevin and a no hitter was his pitch count. today it was the rematch. and it was up to dallas braden to give the visitors a shot. he allowed just five earned runs in his last five road starts. flowy working a no hitter on the
